President took part in the work of the Sejm Subcommittee on Artificial Intelligence
The Personal Data Protection Office wants to support legislators in their work on solutions regulating the operation of artificial intelligence. Personal data are crucial for artificial intelligence, because they are very often used to learn.
On 9 May 2024, Mirosław Wróblewski, the President of the Personal Data Protection Office, presented information to MPs from the Standing Subcommittee on Artificial Intelligence and Transparency of Algorithms on the work at the Office on a proposal for guidelines on the design and adaptation of national law to data protection requirements in connection with the use of artificial intelligence systems. The proposals contained in the guidelines may be used by the Ministry of Digital Affairs and other ministries as well as the Parliament in legislative work.
The right to data protection is a key element in the management and regulation of AI systems, which requires continued attention and adherence to data protection rules by all entities processing personal data using these technologies. Therefore, in the opinion of the President of the Personal Data Protection Office, it is necessary to agree on a common approach to personal data protection under the GDPR and the European Artificial Intelligence Act. In today's world, GDPR principles such as the following become crucial:
- Data minimisation, purpose limitation, accuracy, integrity, and confidentiality, are essential for the proper implementation of AI;
- Focusing on the rights of access, rectification, erasure, restriction of processing of your data and the right to object to the processing of data. AI systems must be designed to enable these rights to be exercised in an easy and accessible way;
- Of particular importance in the context of AI is Article 22 of the GDPR, which regulates the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning a person or similarly significantly affects him or her.
