Public consultation in the legislative process the subject of talks between the DPA and the Sejm
The introduction of a new legal institution, i.e. public consultations on draft legal acts submitted to the Sejm, (lower chamber of the Polish Parliament) has been the subject of meetings between representatives of the Personal Data Protection Office and the Office for Expertise and Regulatory Impact Assessment of the Chancellery of the Sejm.
Meetings to discuss the possibility of regulating public consultations that would be required for all draft amendments to the law that go to the Sejm were held on 10 and 17 May 2024. On the part of the Personal Data Protection Office, they were attended by Agnieszka Grzelak, Deputy President of the Personal Data Protection Office and Monika Krasińska, Director of the Case Law and Legislation Department at the Personal Data Protection Office, as well as other experts of the supervisory authority.
Representatives of the Office, together with staff from the Office for Expertise and Regulatory Impact Assessment of the Chancellery of the Sejm and the Bureau of Research of the Sejm, focused on discussions around what existing regulations should be amended to introduce the new institution of public consultation during work on draft amendments to the law brought before the Sejm.
The Personal Data Protection Office’s experts presented their proposed solutions and expectations regarding the regulations on ensuring the application of the GDPR and other regulations on personal data processing, which will be further analysed by the representatives of the Sejm. The discussions focused on the creation of an optimal legal basis from the point of view of the principle of legality of the processing of personal data.
