Ministry of Economic Development considers the President’s of the Personal Data Protection Office request regarding land and mortgage registers legitimate
The Ministry of Economic Development and Technology thanks for the President’s submitted position and proposal. ‘They are understandable to us and we consider them to be fully justified,’ the ministry elaborates.
"The provisions of the Act of 5 July 2018 on facilitations in the preparation and realisation of housing investments and accompanying investments (Journal of Laws 2024, item 195) will be amended to ensure that the principles of personal data protection are respected. This will happen on the occasion of the forthcoming legislative work on the Act undertaken by the Department of Spatial Planning," the Secretary of State at the Ministry of Economic Development and technology, Michał Jaros, told the President of the Personal Data Protection Office.
This is about the obligation, enshrined in this Act, to include land and mortgage register numbers in applications for establishing the location of investments and in the resolutions of the municipal council adopted in these matters.
The provisions of the Act provide for the obligation to publish the investor's application and the resolution of the municipal council in the Public Information Bulletin and the Voivodeship Official Journal, respectively.
The land and mortgage registers numbers of both the properties on which the investments will be carried out and other properties that may be affected by the investments are thus made public.
The President of the Personal Data Protection Office drew attention to this problem in a speech on 11 March and received a response on 4 April. In a letter dated 7 April (DPNT.413.15.2025), he pledged expert assistance in drafting legislation that properly protects personal data.
