The President of the PL SA draws attention to the operation of a foundation promoting sharenting
According to the President of the Personal Data Protection Office, Mirosław Wróblewski, the objectives indicated in the statute of the "Children are with us" foundation may be contrary to the law, as they violate the rights and freedoms of children, including the right to image protection and privacy. This foundation promotes the publication of images of children on the Internet and does not agree with the postulate of limiting the so-called sharenting. Therefore, the President of the Personal Data Protection Office asked the Minister of Family, Labour and Social Policy, Agnieszka Dziemianowicz-Bąk, to consider taking appropriate supervisory actions against the foundation and persuading the foundation to cease activities that violate children's rights to the protection of their personal data and privacy. Its competence includes supervising the foundation.
Sharenting involves publishing the image of a child in a digital environment. An example is posting photos of children on a social network on an open user account. The image of their minors is made public online by as many as 40 percent of parents. Such action can cause a number of threats to children and their privacy: provide material for deepfakes, photomontages or expose the child to peer violence.
The Personal Data Protection Office has been educating about protecting the image of children for a long time. An example is the activities for schools under the "Your Data - Your Concern" program, as well as a guide on protecting the image of children entitled "Child's image on the Internet. To publish or not?", created in cooperation with the Orange Foundation.
In the letter, the President of the Personal Data Protection Office reminds that the right to privacy established in Article 47 of the Constitution of the Republic of Poland guarantees every citizen of the Republic of Poland, regardless of age, the right to legal protection of private and family life, honour and good name, and to decide about their personal life.
