Complaints concering data processing

Persons whose data are processed within the Entry/Exit System have the right to the protection of their personal data, including the right lodge a complaint in the event of a violation of these rights.

Travelers can lodge a complaint if:

  • they are refused access to or rectification of the data,
  • the data have been unlawfully processed.

A complaint may be lodged with:

  • the national data protection authority of the European country using the EES, which is responsible for data processing (in Poland – the President of the Personal Data Protection Office),
  • European Data Protection Supervisor  on matters concerning the processing of data by EU agencies, such as:
    • Frontex: - the European Border and Coast Guard Agency,
    • eu-LISA – the EU Agency for the Operational Management of Large-Scale IT Systems;
    • Europol - the EU Agency for Law Enforcement Cooperation.

It should also be remembered that in the case of personal data processing by competent authorities in connection with the prevention and combating of crime, the data subject has the right to lodge a complaint with the President of the Personal Data Protection Office within 30 days from the day on which he or she learned about the breach or received information from the data controller.
